WPTF Event Code of Conduct


CODE OF CONDUCT AND RELEASE OF LIABILITY AGREEMENT

Registrants for all WPTF Events and Meetings will be asked to acknowledge this Code of Conduct and Release of Liability Agreement during the registration process.

I desire to participate in the off-site meeting, event, retreat, function, training, roundtable or other engagements (collectively, “Off-Site Meetings”) organized, held, and/or otherwise conducted by or sponsored by the Western Power Trading Forum, a California nonprofit mutual benefit corporation (“WPTF”) and in consideration for my participation, I agree to the following terms and conditions as set forth below:

1. Purpose and Scope
This Code of Conduct establishes expectations to ensure off-site interactions are respectful and compliant with law, and aligned with WPTF values.


2. Professional Behavior
•           Treat all participants, venue staff, and third parties with courtesy, dignity, and respect.

•           Do not engage in harassment, discrimination, bullying, retaliation, or any form of abusive conduct, whether verbal, non-verbal, written, or physical.

•           Comply with all applicable laws and venue rules

•           Avoid conduct that could reasonably be perceived as creating a hostile, intimidating, or unprofessional environment.

3. Substance Use and Alcohol

•           The use of illegal drugs is prohibited.

•           If of legal drinking age, please drink responsibly.

•           Never drink and drive; comply with WPTF transportation guidance for return travel.

4. Health, Safety, and Security
•           Follow venue safety rules, posted instructions, and organizer guidance.

•           Report hazards, injuries, or unsafe conditions immediately to the organizer.

•           Keep personal belongings secure; the WPTF is not responsible for loss or theft except as required by law or policy.

5. Compliance, Reporting, and Enforcement
•           Violations of this Code or related policies may result in corrective action, up to and including removal from the event, disciplinary action, or termination, consistent with applicable law and WPTF policy.

•           Report concerns promptly to the event organizer, any HR Contact, or through the WPTF executive director.  Retaliation against good-faith reports is prohibited.

•           The WPTF may investigate reported concerns and take appropriate remedial measures, including restrictions on participating in future WPTF events and/or expulsion from WPTF membership.

6. Amendments
•           The WPTF may amend this Code at any time; material changes will be communicated to participants.


7. Release
•           I HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE WPTF OR ANY OF ITS MEMBERS, EMPLOYEES, AGENTS, INDEPENDENT CONTRACTORS, INSURANCE COMPANIES, ATTORNEYS, AFFILIATES, SUBCONTRACTORS, VENDORS, LANDLORDS, LESSORS, AND/OR ITS SUCCESSORS IN INTEREST (COLLECTIVELY, “RELEASEES”) FROM CLAIMS, CAUSES OF ACTION, DEMANDS, LOSSES, OR DAMAGES ON ACCOUNT OF INJURY OR LOSS, INCLUDING DEATH OR DAMAGE TO PROPERTY, CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE RELATED TO OR ATTRIBUTABLE TO MY PARTICIPATION IN ANY OFF-SITE MEETINGS AND ITS RELATED SERVICES.

8. Choice of Law
•           ALL CLAIMS OR DISPUTES ARISING OUT OF OR RELATING TO THIS AGREEMENT, ITS INTERPRETATION, PERFORMANCE  AND/OR BREACH, INCLUDING WITHOUT LIMITATION ALL CLAIMS OR DISPUTES ARISING OUT OF RELATING TO YOUR ATTENDANCE OR PARTICIPATION IN OFF-SITE MEETINGS SHALL BE RESOLVED BY BINDING ARBITRATION IN ACCORDANCE WITH THE COMMERCIAL ARBITRATION RULES AND MEDIATION PROCEDURES OF THE AMERICAN ARBITRATION ASSOCIATION (“AAA”) (AVAILABLE AT https://www.adr.org/media/qielmf0g/2025_commercialrules_web.pdf OR BY TELEPHONING 1-800-778-7879), AND JUDGMENT UPON THE AWARD MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF.  THE LAWS OF THE STATE OF CALIFORNIA, INCLUDING ITS STATUTES OF LIMITATIONS APPLICABLE TO THE COMMENCEMENT OF A LAWSUIT, SHALL APPLY TO THIS ARBITRATION HEREUNDER.  PAYMENT AND FILING, ADMINISTRATION AND ARBITRATOR FEES WILL BE GOVERNED BY THE AAA’S COMMERCIAL ARBITRATION RULES 55 THROUGH 60.


9. Acknowledgment
Attendance at an Off-Site Meeting constitutes acknowledgment of, and agreement to comply with, this Code and all referenced policies.  I acknowledge that I have read this Agreement in its entirety, understand its terms, and agree to be bound by them.  I further acknowledge that I have had an opportunity to ask questions and seek clarification regarding the terms of this Agreement.  By signing this Agreement, I acknowledges that I have read, understood, and agree to the terms and conditions of this Agreement.
